These Terms and Conditions ("Agreement") govern the use of services provided by KB Haulage Canada ("the Company", "we", "our", "us"), a logistics and transportation service provider. By utilizing our services, you ("Client", "you", "your") agree to be bound by the following terms:
1. Services Provided
KB Haulage Canada offers transportation and logistics services including, but not limited to, freight transportation, cargo handling, storage, and related logistics services. Specific services and their fees will be agreed upon in writing or via electronic communication.
2. Pricing and Payment
All service rates will be provided in advance, and any additional costs (e.g., fuel surcharges, tolls, special handling) will be communicated to the Client.
Payments must be made in full as per the terms agreed upon at the time of booking, including any applicable taxes.
Payment can be made via [accepted payment methods such as credit card, bank transfer, etc.].
In the event of late payment, the Client agrees to pay interest on overdue amounts at the rate of [X]% per month or the maximum allowed by law, whichever is higher.
3. Booking and Scheduling
All transportation services must be booked in advance, and the Client is responsible for providing accurate and complete information about the cargo, delivery points, and any special requirements.
The Company will confirm all bookings, including estimated pick-up and delivery times. However, delivery times are estimates and are not guaranteed.
4. Cargo and Packaging
The Client is responsible for ensuring that all cargo is properly packaged, labeled, and compliant with all applicable regulations for transport.
The Company is not responsible for any damage or loss caused by inadequate packaging or failure to adhere to safety and regulatory standards.
5. Liability and Insurance
KB Haulage Canada provides liability coverage for cargo in transit in accordance with Canadian law. However, Clients are encouraged to obtain additional insurance for high-value items or goods that require special handling.
The Company’s liability for loss, damage, or delay to the cargo will be limited to the lesser of the actual value of the goods or [X] CAD, unless the Client has purchased additional insurance.
6. Delays and Force Majeure
The Company is not responsible for delays or failure to perform due to causes beyond our control, including but not limited to weather, road closures, accidents, strikes, or government regulations.
In the event of such a delay, the Company will make reasonable efforts to notify the Client and provide an estimated new delivery time.
7. Termination and Cancellations
The Client may cancel a booking by providing at least 10 hours' notice before the scheduled pick-up time.
Cancellations within 10 hours may be subject to a cancellation fee equal to [20]% of the total service charge.
The Company reserves the right to cancel any service at its discretion if necessary due to safety, legal, or operational issues.
8. Confidentiality
Both parties agree to keep any confidential information, including business operations, financial data, and any other proprietary information, confidential and not disclose it to any third party without prior consent.
9. Governing Law
This Agreement will be governed by the laws of the Province of [ON], Canada, and the parties submit to the exclusive jurisdiction of the courts located in [BELLE RIVER, ON].
